These are some of the key questions addressed in the newly published report “Arbitration and Artificial Intelligence: Principles and Recommendations for the Use of AI Systems in Arbitral Proceedings” (“Arbitraje e Inteligencia Artificial: Principios y recomendaciones para el uso de sistemas de IA en los procedimientos arbitrales”), prepared by the Working Group on Digital Economy and Intellectual Property of the International Arbitration Centre of Madrid (Centro Internacional de Arbitraje de Madrid, CIAM-CIAR). The report, led by Teresa Rodríguez de las Heras Ballell, examines both the opportunities and risks of applying AI to arbitration, while outlining essential principles such as party autonomy, protection of confidentiality, procedural integrity, arbitrator responsibility and oversight, traceability, and regulatory compliance. It also establishes a foundation for CIAM-CIAR’s future regulations on the use of AI in international arbitration.
